Interesting. The relevant quote is "under copyright law, for works created before 1978, when an author dies before the original term of a copyright grant expires, rights revert to the heirs." I wonder if this also holds true for works made for hire, which I presume the "Hawaii Five-)" theme to be?

Most unfortunate, for both sides. I'm quite a fan (spoiler: sacrilege coming up) of both the new show and Brian Tyler's arrangement of the theme. Both are updates that, to me, keep the spirit of both the music and the show intact. I'd be sad to hear that they'll need to replace the theme, both on subsequent seasons as well as the season 5 DVD set.

I do, however, feel for Morton Stevens' family, who feel slighted. It'd be nice if CBS would extend an olive branch in some fashion, but I doubt that's going to happen.

They could surrender the copyright claim to the family, pay them residual fees, and come to an agreement on royalties for future use.

If I read it right it's some other claimant or lawyer who lost an unrelated case and snoop around and found something they could sue over in revenge. The family apparently had no idea his work reverted back to them.

Yes, that's how I read it, too, and I agree with your idea about how CBS could handle it. Something tells me that's not how they'll handle it, though. Unfortunately the way the legal system is set up, your hurting yourself by doing the "right thing" because it could have a negative impact on future legal matters.

I thrill to hearing the theme on the new show in 5.1 surround, although it's abridged. And, I like the show, though as compared to the original, it's an absurd cartoon.

I remember when some heirs of some composers sued C.B.S. for royalities due from the music on the "Have Gun, Will Travel" D.V.D.s. Could there be a smiliar case with the "Hawaii Five O" D.V.D.s?

Looks to me like Stevens' heirs (now-deceased wife, plus son and daughter) not only missed the boat in 2010 when the theme was used for the new show, but in 1969 when the original theme was published and copyrighted by CBS:

Hey, I did a little presentation in jr. high on this theme, tied in with the Ventures' version. Even used phrases like "mixolydian mode" and whatever else I could steal from the teacher. Eh, was more of a theme fan than series fan. Must've been a sign of early film music geekdom setting in or something. Geez what am I saying!eek
