Most unfortunate, for both sides. I'm quite a fan (spoiler: sacrilege coming up) of both the new show and Brian Tyler's arrangement of the theme. Both are updates that, to me, keep the spirit of both the music and the show intact. I'd be sad to hear that they'll need to replace the theme, both on subsequent seasons as well as the season 5 DVD set. I do, however, feel for Morton Stevens' family, who feel slighted. It'd be nice if CBS would extend an olive branch in some fashion, but I doubt that's going to happen.

They could surrender the copyright claim to the family, pay them residual fees, and come to an agreement on royalties for future use. If I read it right it's some other claimant or lawyer who lost an unrelated case and snoop around and found something they could sue over in revenge. The family apparently had no idea his work reverted back to them.

Something tells me that's not how they'll handle it, though. Too bad, because we may end up with a different theme for the show. The family and the fans would both lose in that case. Not to mention the season 5 DVD set would most undoubtedly be changed. Lawyers! I know several and love them, but laaaawyers!
