Someone recently commented that FSM's Patton has appeared on iTunes... well, today I discovered that Intrada's out-of-print edition of Lock Up (otherwise known as Haute Sécurité!) can be purchased on iTunes for $9.99.

I own both CDs, so it makes little difference to me, but I'm curious to know if these iTunes releases are legit, or if they happened via a legal loophole of some kind...

How can limited editions show up on iTunes at all? Do iTunes have to take them down when the CD and download sales reach 3000?

How can limited releases be available on iTunes???

Unfair for the people who purchase the actual sold out limited cd's for a substantial amount.

But I guess like Joan advised Tina...

This is strange. I talked to Jeff at Intrada about this, and he was going to bring this up with Doug, because this has nothing to do with their original (and now sold-out) CD.

Many times a licensor holds onto electronic download rights. With LOCK UP, we didn't have them. The licensor is, of course, free to do what they want with them. So they may have put it up themselves like Disney has been doing.

I don't understand what you mean. If they happened via a legal loophole, wouldn't that make them "legit," or are you using the word in some other sense?

I'm sure they're up there not through the labels, but through the studios (or whoever owns the rights to the recordings, as opposed to labels like FSM and Intrada that license them for their editions).

I meant something unscrupulous - but Roger F.'s explaination makes a great deal of sense, so it's probably legit.

I noticed that the Varese-edition of BASIC INSTINCT was on the Canadian iTunes store, a surprise because there isn't a single Varese album on the Canadian store.

FYI, BASIC INSTINCT is no longer licensed to VARESE and if it's up on ITUNES, I'd like to know who put it there myself since I made the deal for PROMETHEUS RECORDS that granted them SOLE RIGHTS to this title for the term of their agreement.

Let's be clear on what a limited edition means: it means that that particular CD from that particular label will not be released again. It does not mean that that music will be forever unavailable. (And really, is that what we would want?) Thus, Varese's limited "Cherry 2000" showed up years later on Prometheus.

Every contract is different (well, actually, a lot are full of boilerplate sameness, but you get my point). It seems that, once FSM sold out their run of 3,000 "Patton" CDs, 20th Century Fox (which continues to own the music itself) put it up on iTunes. "Lock Up" seems to be in a similar situation. If Intrada had purchased all media rights in perpetuity, that would not have been possible. But they apparently did not. (And why would they have?)

I missed out on the Intrada release - so I was very happy to come across it on iTunes.

Of course this is not available in the US currently. This would probably be the one album I would purchase via download, until I find another album I really want smile
