If you are one of the poor unfortunates who ordered anything from Pure Destructive Records (https://puredestructiverecords.bigcartel.com) and are still waiting, you can rest assured you won't be getting your record(s). After months of endless postponements via their website and promises of refunds that never came, their latest autoresponder reads as below. Hope nobody here paid out for a subscription or anything:

I am currently going through personal Bankruptcy proceedings.

The law firm handling the bankruptcy is

CUTLER AND ASSOCIATES LTD
4131 MAIN STREET
SKOKIE,IL
60076
TEL : 847-282-4899

For further assistance please contact the bankruptcy law firm above

Well in that case, if you paid with a credit card, call your CC company and dispute the change.

If you paid using. PAYPAL, do the same.

Your chances here at getting your $$$ back are fairly good.

If you sent them a check via the post office, file a claim with the post master's office.

This might take longer and may note work, but it's worth shot.

Unfortunately they've strung this out longer than 180 days, so Paypal automatically decide in the seller's favour with any dispute.

That company certainly lived up to its name.

How can they side with the company? You have proof via the bankruptcy they never sent out the product. I would press Paypal anyway.

In the details of what they had selling, they stated the payment wasn't refundable.
Well, at least not by their own will.
In other board, there are people who pre-order more than a year and a half ago and never got any e-mail about the delay.

The way the whole thing was dealt with by the owner was bizarre.

Even more bizzare is the fact that some people order and pay for something - and then wait for more than half a year without trying to get their money back. wink

Nonrefundable usually applies when pre-ordering an expensive item. Its partial protection for the retailer in case a customer backs out of the sale. When a business doesn't deliver the product and keeps the money that's fraud.

Except when a company name suggests "Caveat Emptor." If they were "Super Happy Fun Customer Records," that's fraud.

It's not as simple as that though is it? First you get a pressing delay and you get a new date. Then when that comes they say there was a problem with the artwork and they are redoing it. Then they say it was held up in customs. Then they give you a shipping date. Then when that passes you start asking for your money back. Thanks for your sensitivity though.

What exactly were these people selling. Clicking on the website gets "Check back soon."

Checking Google - they did seem to ship Night of the Comet?

I not sure if the rights would allow, but as the mostly titles were not from major studios, the digital copy option would make mostly customers satisfied.
If so, by now the release on the novelty format would be canceled anyways.

Looks like they had at least 6 releases.

I'd be interested to know if anyone actually has any of their releases in hand.
