Man, this really is a crusade for you, isn't it?

Yes, the two pieces are similar but this isn't the first time it happened in (film) music and it most certainly won't be the last time. Pemberton is easily one of the most creative and fun composers currently working in Hollywood. As explained above there could be several reasons why the two pieces are similar. It's really not worth obsessing over this much.
