A curious one. Given that the music is public domain in Europe, it is unclear what legal issues there are. The score has not been uploaded on download services either, which means that less-than-scrupulous labels have either not found on a copy or don't care!

Not curious at all. Whether the music is public domain in Europe is not the decisive point here. The score has not been released here in Europe by an European label, but it was intended to be released in the US by an US label - and there the sound recording copyright for such a a score is still fully intact. This means that only a European (or for example Canadian) label could release the music for their region without having to license it from the US studio or whoever has the rights in the US for it.
The listing on eBay is a BUYSOUNDTRAX release (Dragons Domain Records). Look at the eBay listing... Even has a UPC # What gives? How is it that no one knows about this - if it is a legit release.

It depends on how you define these things.
It was produced as a legitimate release and likely manufactured but withdrawn before it was released. There have been a few releases like this (Blood In, Blood Out comes to mind) where a few copies somehow made it out despite the release being canceled.
Of course, we have no way of knowing if the copy you see on eBay is like that or if it was created by somebody else using the audio files that some received with purchase before the physical product was pulled.
