I was talking about perseverance's statement about the licence of the score album

as stated on the site :

Our second album with David Newman, this animated feature follows in the footsteps of classics such as his "Anastasia" and "Ice Age". In style similar to Newman's "The Air Up There", this score features sweeping melodies, battling drums and an African choir. The album contains the complete orchestral score and is different from the previous European release inasmuch as it doesn't have the songs by Naturally 7 and Xavier Nadoo. Produced by David Newman and Robin Esterhammer.

Available only to buyers in North America, Japan, Australia and New Zealand. Our license does not allow us to ship to European customers. Sorry.

Nope. I guess they were only able to get rights if they agreed not to put their product in competition with the European release.

Indeed a European release (Konferenz der Tiere) already exists.
ONLY 16 tracks though

WOW.

Looks like an amazing release, and it certainly came out of left field. I hardly expected an expanded release of this score to come out anytime soon, given the already existing release; I was tempted to buy the other release for a while, but its high price put me off - now with this news, I'm glad I waited.

VERY highly considering picking this one up! David Newman is my favorite composer and he needs more of his music released on disc. Thank you, Perseverance. smile

Here's the other release to compare, by the way:

Thats horribly disappointing and incredibly short sighted on someones part.

Given how large our community is, its fairly unlikely EU sales would have much impact on a separate release which is likely available in Shops, on Amazon and what not; i.e. the places that the masses would be looking to buy the soundtrack.

Or order from a retailer that does ship to Europe. Which is pretty much any of the major ones, I think.

I love David Newman, but this is one release I'm not willing to support. And it's completely ignorant not to include a European license, no matter who is at fault for that.

How is that "ignorant"? The score had already been released in Europe; it's likely that in order to license the music at all, the label contractually had to agree not to release it there. It's not like they just decided that the European market isn't worthy. But they probably had to agree to the terms of the license-holder or not release the music at all.

So what if it's not licensed for Europe? Other outlets (Intrada, SAE, MovieMusic) are inevitably going to stock this CD, and they'll ship it out to European customers anyway. This score is getting the expanded treatment it deserves and I couldn't be happier.

Customary of people on FSM to dig through the fruit just to pick out all of the sour apples, though. Sigh. roll eyes

So what if it's not licensed for Europe?

Quite a lot, first we have to skirt around the license agreement to import from a seller willing to ignore the license agreement; which is probably illegal in the studio's eyes.

I'm just thankful that the record industry didn't go into region locking CD's, otherwise then I would have been seriously pissed off. (Circumventable or not)

Plus I wonder if there would be more outrage if say this years Delure album wasn't available to the North American & Canadian territories, or the Santa Claus The Movie album from a couple of years ago, because of a license preventing sales to those customers.

Other outlets (Intrada, SAE, MovieMusic) are inevitably going to stock this CD, and they'll ship it out to European customers anyway.

I hope that is true, however we don't know yet if they will stipulate to Intrada/SAE/whoever that for them to get stock that they can't sell to a European address or worse still, prevent European IP addresses from purchasing the music (like say Amazon).

It appears like there are always members of this forum who criticize anything I do; unfortunately, that cannot be helped. But I still think that I can make a lot of fans happier by my actions than if I didn't release this soundtrack. I, too, am a big fan of David Newman, so when I had an opportunity to release this score in expanded form to people outside of Europe (or not at all), I opted for the first.

When I first saw in Variety that David had scored this picture, I immediately wanted to get out a CD. It was difficult to get this license to begin with, as the original license lay with a European record label and had to be broken up in order to grant me the rights in the specified countries. I also have to add that my original agreement with Constantin only granted me the rights to re-release the EU version of the soundtrack, something I wasn't interested in. Fortunately, I found open ears in the head of Constantin Music, who accepted my proposal to release the complete score without the songs that interrupted the musical flow on the original release.

I am very happy with this album. I hope some of you will be, too.

Robin Esterhammer

Please ignore the troll Mr. Esterhammer. It's clear that the individual in question has an agenda based on malice - I say this based on the way over the top super flame-out he had last spring on this board.

You're doing just fine. Congrats on your new release!

Thiss happens all the time with Naxos downloads re: different time considerations for "public domain". It sucks, it is what it is.

At least with a physical CD you can easily buy it on the secondary market.

With downloads, your pretty much SOL.

I am definitely happy with how this turned out. So, thank you Robin, and thank you Constantin Music. I will be picking up a copy in the coming weeks.

Fantastic news. The original album sucks. It leaves off app. 50 minutes of important material. That score has truly symphonic proportions, very memorable themes and the recording has a fantastic concert hall ambience. Also the performance by the Berlin musicians is terriffic.
